Terms of Service

Effective 26 August 2026 · TaskMind-AI (taskmind-ai.co.za)

1. Who we are, and what you're agreeing to

TaskMind-AI ("TaskMind-AI", "we", "us") provides a managed AI chatbot service for websites at taskmind-ai.co.za (the "Service"). By creating an account, subscribing, or using the Service in any way, you ("you", the "Customer") agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of a business, you confirm you are authorised to bind that business.

2. The Service

The Service lets you create, manage and embed AI-powered chatbots ("bots") on your website. Bots answer visitors using content you provide and third-party artificial-intelligence models. The Service is provided as a subscription and is managed by us, but the content your bots are taught, and everything your bots say to your visitors, remains your responsibility as set out below.

3. Fees and billing

The Service is billed monthly, in advance, per active bot at the price shown at checkout. Your first payment is taken when you subscribe; each renewal is charged automatically one calendar month after the start of the period it follows, using the payment credential you saved with our payment processor. By subscribing you expressly authorise these recurring merchant-initiated charges until you cancel. If you add bots, your next renewal reflects the new count; prices may change on notice, applying from your next billing period.

If a renewal payment fails we will retry it a limited number of times. If payment still cannot be collected, your subscription is suspended and your bots stop responding until payment succeeds. We may correct billing errors in either direction.

4. Cancel anytime — but no refunds

You can cancel whenever you like, and when you do, you keep full use of the Service until the end of the month you have already paid for. What you do not get is that month's money back: all payments are final and non-refundable, to the maximum extent permitted by law. This includes partial months, unused time, bots you paused or deleted mid-period, dissatisfaction with AI-generated answers, and forgotten cancellations. You expressly agreed to this no-refund policy when you created your account. Cancelling stops future charges; it does not refund past ones. Nothing in this clause limits any right you may have under the Consumer Protection Act 68 of 2008 or other law that cannot be excluded by agreement.

5. Cancellation

You may cancel at any time, in a few clicks, from your dashboard — there is no notice period, no phone call and no penalty. Your subscription then runs to the end of the period you have already paid for — your bots keep working until that date — and nothing further is charged. We may suspend or terminate your access immediately if you breach these Terms, abuse the Service, or use it unlawfully; no refund is due in that case.

6. AI output — important disclaimer

Bot responses are generated by artificial intelligence. AI output can be wrong, incomplete, outdated or misleading, and may occasionally say things you did not teach it. You are solely responsible for the content you give your bots, for reviewing how they respond, and for everything your bots communicate to your visitors. Bot output is not legal, medical, financial or other professional advice, and we make no warranty of accuracy. You must not rely on the Service in any situation where an incorrect answer could cause harm.

7. Your content and your obligations

You retain ownership of the content you upload or teach your bots. You warrant that you have the right to use that content and that it, and your use of the Service, is lawful. You agree not to use the Service to mislead, spam, harass or harm anyone; to collect personal information unlawfully; to infringe intellectual-property rights; or to attempt to probe, overload or interfere with the Service. You grant us the licence needed to host and process your content solely to operate the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

8. Visitor data on your website

Conversations, leads and bookings captured by your bots from your website visitors belong to you, and you are the responsible party for that personal information under applicable data-protection law. We process it on your behalf to provide the Service, as described in the Privacy Policy. It is your responsibility to give your visitors any notices and obtain any consents the law requires of you.

9. Third-party services

The Service depends on third parties, including AI model providers (which process conversation content in order to generate replies), our payment processor (which stores payment credentials — we never hold your card number), and hosting providers. We are not responsible for the acts, omissions or availability of third-party services.

10. Availability — the Service is provided "as is"

We work to keep the Service reliable, but it is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted, error-free operation. We may modify, suspend or discontinue features, and perform maintenance, at any time.

11. Limitation of liability

To the maximum extent permitted by law: (a) we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data, lost business or reputational harm, however caused; (b) we are not liable for anything an AI-generated response says or omits, or for any decision made in reliance on it; and (c) our total aggregate liability arising out of or relating to the Service is limited to the subscription fees you paid to us in the three (3) months preceding the event giving rise to the claim. These limits apply to any theory of liability, including negligence, and survive termination.

12. Indemnity

You indemnify us and hold us harmless against any claim, loss or expense (including reasonable legal costs) arising from your content, your bots' interactions with your visitors, your breach of these Terms, or your violation of any law or third-party right.

13. Changes to these Terms

We may update these Terms from time to time. The current version is always at this address, with its effective date above. Material changes will be signposted in the Service or by email. Continuing to use the Service after a change takes effect means you accept the updated Terms.

14. General

These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction. If any clause is found unenforceable, the rest remain in force. These Terms, together with the Privacy Policy, are the entire agreement between us regarding the Service. Our not enforcing a right is not a waiver of it. You may not assign this agreement without our consent.
